My two friends and I were pulled over one afternoon. I was driving ( I am a black male about 59, 140lbs) the passenger (an afghan about 510, 200lbs) and a caucasian in the back seat (about 57 140). We were pulled over because we fit the description of a strong armed robbery suspect (me and the afghan). They asked us for our IDs and ran a background check to make sure we werent who they thought we were. They made us get out of the car so they could take our pictures. At that point they were looking into the car without actually searching it. After we all got back in the car, they asked if we smoked in the car alot and asked about some tobacco that had spilled in the car. After this they saw my black backpack, and asked to look inside of it because a blue blackpack had been reported stolen in the robbery. After I had told them that i did not give consent to search the car because there was no evidence of the robbery, one of the officers opened my car door and took my backpack out and had asked me if there was marijuana in the backpack and i told them there was. On the officers dispatch i heard the suspect was a 63 black male about 210lbs. They even had a description of the car and the license plate number neither of which macthed my car. And also, i dont know if it helps or not, the arresting officer has been following me around my area for almost a year now. he has come up to me on multiple occasions maybe trying to intimidate me. and he also spelled my name horrible wrong after i corrected him twice. after he found the weed, he first said it looked like it was more than a half ounce, then stated it was about a quarter, but on the police report stated that it was only an eighth but im being charged with possesion of marijuana and paraphenlia. and if your about to tell me to stop using the race card then fuck you and stop pretending like it doesnt happen you ignorant fucks the only part of the description i fit was being black and with a mid-eastern fellow... just because the backpack was in plain view doesnt give them a right to grab it. it was still in the car and there was no reason for them to take it without my consent.

And why is it that 4, count 'em, FOUR, of the FBI's 10 most wanted criminals were Hispanics, two of them "immigrants" for sure.

PHOENIX, AZ – Authorities say investigators with the Illegal Immigration Prevention and Apprehension Co-op Team recently captured eight human smugglers and rescued 23 human smuggling victims from Phoenix and Glendale drop houses. IIMPACT investigators arrested Salvador Rodriquez, Edward Geraldo-Ramirez, Freddy Hernandez, Santiago Bermudez-Gomez, Luis Quezada, Julio Camargo-Vasquez for their alleged involvement in human smuggling schemes and drop houses in the past month, according to a Tuesday news release. The arrests were made during two separate human smuggling incidents on November 20 and December 6. On November 20, investigators responded to a tip from a relative of a human smuggling victim after she paid $3,000 to human smugglers to “secure her relatives’ release.” Authorities located the suspected drop house at 4151 West Earll Drive in Phoenix and numerous suspects reportedly tried to run from the residence. Three suspects, later identified as Camargo-Vasquez, Quezada, and Bermudez-Gomez, were located and arrested while 15 victims were found inside the home, officials say. Investigators also found a stolen police-issue handgun and two cell phones, presumably to call relatives for ransom money, according to authorities. Officials reportedly later found that the victims were kept in a back room where reverse deadbolts were implemented on the door. Camargo-Vasquez, Quezada, and Bermudez-Gomez are currently facing charges of human smuggling. The second incident, on December 6, was also the result of a tip IIMPACT personnel received regarding a Mexican national being held against his will in a suspected drop house. Authorities located the suspected drop house at 5130 North 68th Avenue in Glendale and used the aid of a SWAT team to investigate the property. Investigators caught two suspects who attempted to flee the residence and another in the driveway of the home; all were later identified as Rodriquez, Geraldo-Ramirez, and Hernandez, according to authorities. Basically long story short, strong arm robbery and battery, hit me in the stomach and stole my pain medication. I have Ankylosing Spondolytis, my Dr. will not refill my prescription for a month. Of course, as the first poster mentioned, this won't be cheap and unless you can get an attorney to take the case on contingency, you'll have to shell out several thousand for a retainer and possibly more money as the case progresses. ---------------------- You have the right to represent yourself in a civil case, but the defendant also has a right to an attorney if he can afford one, or someone takes the case pro bono. If he gets someone to represent him and you don't have an attorney, you'd be walking through a mine field. Talk to legal aid and see if they'll take the case.

Detective Callahan sees a man driving a car down a city street. Callahan recognizes the man as someone with an active warrant for armed robbery. Callahan turns around on the suspects vehicle and attempts to catch up to it. Callahan finally reaches the suspect at the suspects house. The suspect has just stepped out of his car and locked and shut the door. Callahan approaches the suspect and arrests him based on the active warrant. Callahan then handcuffs the man and places him in his patrol car. The detective then takes the suspects car keys and unlocks the car and searches the passenger area. Under the drivers seat Callahan finds a pistol and ski mask used in the robbery. The car is parked in the suspects driveway. The suspect told Callahan he did not want him looking in the car and the detective does not have a search warrant for the vehicle. Is this search legal? Why? This should be an easy one. Intersting answers. Remember Carroll Doctrine requires a vehicle to be in a public place.
Answer: - So far we've got 5 people saying the search was good, and the same number saying the search was bad, all for varying reasons. If I were the trial judge, I'd find the search lawful, and admit the evidence. - Clearly, the search cannot be justified on the basis of the suspect's consent [1] (since the suspect objected to the search), nor on the basis of the "plain view" doctrine [2] (since the articles seized were found under the driver's seat and, therefore, were not in plain view). - The search is also difficult to justify as an inventory search of an impounded vehicle. Inventory searches must be conducted purusant to "standard police procedures" [3], designed to safeguard the car owner's property as well as protect the police from false claims of lost/stolen property, and the facts didn't mention Detective Callahan conforming to these procedures. - The search is still difficult to justify under the inevitable discoverty doctrine [4] because it's unlikely that the vehicle would have "inevitably" been impounded, since it was located on the owner's property at the time of the arrest. - The Carroll doctrine, permitting warrantless searches of vehicles on probable cause (PC) to believe that items subject to seizure will be found within [5], doesn't seem applicable here, either. - First, the Carroll doctrine generally prohibits warrantless searches of automobiles parked on private property [6]. However, in SCOTUS' decision in Scher, officers searched the trunk of a car whose owner had just admitted to possessing contraband liquor in the trunk, even though the car had just entered a private garage from the public roadway; officers then arrested the driver. The Court confusingly justified the search both under Carroll (as an exception to the "public place" requirement) and as an incident to the driver's arrest [7]. - Moreover, the existence of an arrest warrant is not sufficient for a warrantless Carroll search. An arrest warrant simply means that there is PC to believe that the suspect committed the robbery; a Carroll search requires PC to believe that evidence of the robbery is located inside the vehicle. PC to arrest is neither necessary nor sufficient for PC to search (and conversely, PC to search is neither necessary nor sufficient for PC to arrest). - Since Detective Callahan may not have had PC to believe that the car would contain evidence of the robbery, and Scher may not create an exception to Carroll's "public place" rule, the search would be difficult to justify under Carroll. - However, the search IS valid as an incident to a lawful arrest. Under the Belton doctrine [8], when a vehicle's occupant is arrested, the vehicle's passenger compartment may be searched as an incident to that arrest. - The Belton doctrine was expanded in the Thornton case [9], which stated that even if the officer did not make contact with the occupant until after he/she had parked and exited his/her car, a search of the passenger compartment is valid as an incident to the arrest of the occupant, so long as the arrest and search happened physically close to the car, as well as shortly after the arrestee had exited the vehicle. - Since the suspect had just exited his vehicle at the time of the arrest and search, and the search was of the pasesnger compartment (rather than the trunk), Detective Callahan's search fits within the requirements of the Belton/Thornton rules. In fact, Thornton is probably the case you were thinking of when you posed this question. - So on the basis of the Belton/Thornton doctrine, and because all of El Scott's hypothetical cases end in favor of the government, I would admit the evidence. Sheriffs Office deputies responded to a reported "strong-arm" robbery at the Nordstrom Rack. This alleged strong-arm robbery involved physical force only -- no weapons were involved. This crime is considered as a Robbery in the Third Degree. Two male shoplifting suspects -- ages 16 and 17 -- were allegedly in the process of stealing high-end quality jeans when they were approached by store security. The two suspects then assaulted the intervening store security personnel and fled the scene. One suspect attempted to flee the area on foot; the additional suspect went to an awaiting getaway vehicle with an adult driver. Ben Johnson was arrested by deputies, and is being lodged in Jail on the charge of Robbery in the Third Degree. My question is how much trouble do you think the driver of the vehicle will get in? The driver has a clean record.
Answer: The getaway driver is equally guilty of the robbery. In addition, they may be guilty of 'contributing to the delinquency of a minor'. Without knowing your unnamed jurisdiction, the possible penalties CAN'T be known.

TUCSON, AZ (KOLD) - An illegal immigrant arrested for a violent carjacking remains in the Pima County Jail facing several charges including aggravated assault with a deadly weapon and armed robbery. 24 year old Jesus Moreno-Clark is accused of carjacking a man, at gunpoint and then leading police on a chase the wrong way down Interstate 10 before he was caught. His past criminal history includes auto theft, burglary, assault, narcotic offenses, aggravated assaults on law enforcement. With a rap sheet like that, even Tucson Police Sgt. Fabian Pacheco wonders why he was able to walk the streets, "hes shown a history of fighting with law enforcement, of assaulting police so why is he still out in our community?" In 2006, Moreno-Clark was sentenced to prison for stealing a car. According to the Arizona Dept. of Corrections, he received five disciplinary infractions. Four of those for disobeying an order. He was released last year on the condition he be handed over to U.S. Immigration and Customs Enforcement for deportation, "when criminal aliens are being identified in jails in southern Arizona they are being turned over to ice and in some cases theyre being prosecuted for re-entering the united states," explains ICE spokesman Vincent Picard, "in all cases theyre eventually removed from the United States." Morneo-Clark was deported. In fact, hes been sent back to Mexico several times but in each case, hes managed to sneak back into the United States, "its very concerning," Sgt. Pacheco says, "that an individual with this criminal background, this prosperity of violence, is back on our streets so were fortunate hes back behind bars." Scenario: A man is a key suspect in an armed robbery case. While the police are looking for him, he commits an assault on a woman. Police arrest the man minutes after the assault, and in doing so find evidence that links him to the armed robbery case. Would he likely be tried in one case, facing multiple charges for both crimes? Or would he be tried for the armed robbery, and later face a second trial for the assault.
Answer: No, not necessarily. I responded to a domestic disturbance two years ago. When I arrived I found that the victim who was the defendants roommate, had been beaten and the attacker held a gun to her head. I was informed by the victim that she had been working with the district attorneys drug task force, and have been giving them information about the defendants involvement in manufacturing methamphetamine. While searching the house for the weapon I found the precursors used to manufacture Meth. I contacted the task force and they came to investigate the lab. I filed assault with a deadly weapon, and domestic assault on the defendant. The task force filed manufacturing charges on the defendant. The trial was two days long, and both I and the task force testified on the stand. Same jury, same judge, same trial.

The suspect in the fatal shooting of a 14-year-old Houston girl was an illegal immigrant from El Salvador who previously was deported twice by immigration officials, authorities said. Melvin Alvarado, 22, was convicted of two separate intoxicated driving offenses in Harris County in 2006 and 2007, criminal records show. He was sentenced to 60 days in jail in connection with the last arrest in November 2007. Gregory Palmore, an Immigration and Customs Enforcement spokesman, said immigration officials removed Alvarado from the country in April 2008 and again in May 2009. Palmore said it was unclear from his records whether Alvarado was picked up directly from Harris County Jail after the last intoxicated driving conviction. The second suspect in the fatal shooting of Shatavia Anderson on Saturday, Jonathan Lopez-Torres, 18, was a lawful permanent resident from Honduras, Palmore said. According to Harris County records, Lopez-Torres was arrested and accused of auto theft in February 2009. That charge was later dismissed. The two suspects allegedly saw Anderson as merely a "target of opportunity" for an armed robbery, Houston police homicide detectives said Wednesday. Alvarado and Lopez-Torres were charged Wednesday with capital murder in the Saturday slaying of Anderson, who was known as "Tae" to her friends and family. They were being held without bond at Harris County Jail. Kisha Lambert, the girls mother, was relieved when detectives called her Wednesday with the news of the arrests. "I get to put my daughter to rest and let her know that her killers have been caught," Lambert said. Anderson was shot in the back while she was walking home to her northside apartment in the 1100 block of Langwick. She was last seen alive around 12:30 a.m. Alvarado fled after grabbing some of the girls belongings, including jewelry, a cell phone and her purse, police said. The purse was found in the woods near the teens body around 9 a.m., said Sgt. Billy Bush of the Houston police homicide division. A witness saw the shooting and gave investigators sufficient details about the suspect for a composite sketch. The same witness later identified Alvarado as the killer, police said. Lopez-Torres was the driver, police said. He dropped Alvarado off after the pair saw Anderson walking alone on the street, police said. "It was very cruel," Lambert said of her daughters slaying. "She didnt have nothing worth them taking her life over." Lopez-Torres was taken into custody late Tuesday and brought to HPD headquarters for questioning. Alvarado surrendered later, police said. "They pretty much gave up each other," said Chris Sturdivant, an HPD homicide detective. Bush called the capture of the two suspects "the most fulfilling thing Ive ever done." ATLANTA -- CBS Atlanta News has learned the man accused of killing two women last month is on an immigration hold. Police said Gerardo Hernandez, 31, who is currently in the DeKalb County jail, had been arrested before prior to last months crimes. CBS Atlanta has learned federal immigration authorities have placed a hold on Hernandez, but those authorities have not confirmed that Hernandez is in the United States illegally. But that raises the question. If the counties that arrested Hernandez prior to the charges Hernandez is now accused of, could he have been deported? Here is a time-line of last months crime spree. Chamblee police arrested Hernandez on Oct. 26 during an attempted burglary at a Payless Shoe Source. Investigators said they had already identified Hernandez as a suspect in several other crimes and working to arrest him. Police said on Oct.12 Hernandez was responsible for a home invasion into Maria De Rivieras Forest Park home and that he killed her. On Oct. 16, investigators said he kidnapped Monica Ambriz as she took her lunch break from El Progresso in Jonesboro. According to Clayton County police, Ambriz was raped and killed and her body was found on Oct. 26 in a vacant building off of Arrowhead Boulevard. Investigators said Hernandez is also charged with an armed robbery at El Bank in Jonesboro on Oct. 17, armed robbery and sexual assault at Quick Set in Henry County on the Oct. 23, armed robbery at the Dominican Hair Salon in Henry County on the Oct. 24 and at Paleteria La De Michoacan in Forest Park on the Oct. 25. Police said Hernandez confessed to all the crimes and told them the motive was money. The other crimes were secondary, according to police. It took police from three different counties to track down Hernandez. Investigators credit that cooperation and information sharing with being able to peg Hernandez with all of the crimes. CBS Atlanta News also wanted to know what types of crimes other immigrants were committing. According to statistics from the Gwinnett County Sheriffs Department, there were 2956 illegal immigrants arrested in Gwinnett County since 2008.
