It Teetered, It Tottered, It Was Bound To Fall Down

In Steps Big and Small, Supreme Court Moved Right
It was the Supreme Court that conservatives had long yearned for and that liberals feared. By the time the Roberts court ended its first full term on Thursday, the picture was clear. This was a more conservative court, sometimes muscularly so, sometimes more tentatively, its majority sometimes differing on methodology but agreeing on the outcome in - Supreme Court, in its first full term under Chief Justice John G Roberts Jr, was court that conservatives had long yearned for and that liberals feared; one third of courts decisions, more than in any recent term, were decided by 5-to-4 margins; most of those, 19 of 24, were decided along ideological lines; conservative majority, led by Roberts and joined by Justices Antonin Scalia, Clarence Thomas and Samuel A Alito Jr, prevailed in 13 of ideological cases; courts increasingly marginalized liberals--Justices John Paul Stevens, David H Souter, Ruth Bader Ginsburg and Stephen G Breyer--prevailed in only six; difference depended on how Justice Anthony M Kennedy voted; he was in majority in all 24 of 5-to-4 cases; statistics show that Kennedy is median justice as Justice Sandra Day OConnor was, and he is to her right; summaries of terms major decisions; graph; photos (M) - By LINDA GREENHOUSE

Do you trust the numbers Republicans are pushing about "job crushing" health care refrom?
January 18, 2011
FACT-CHECKING A NON-EXISTENT CBO NUMBER.... Following up on an earlier item, the Republican argument that the Affordable Care Act would cost thousands of jobs is clearly untrue. But theres one talking point in particular were likely to hear repeated, which deserves special scrutiny.
When making the case for repeal, GOP leaders insist that the reform law will cost the economy "650,000 jobs." Republicans even published a report of sorts, claiming that the 650k number is the result of "independent analyses," most notably from the non-partisan Congressional Budget Office.
To its credit, the AP fact-checked the claim today, noting the CBO "never produced the number," and the talking point itself is an example of how "statistics get used and abused in Washington."
What CBO actually said is that the impact of the health care law on supply and demand for labor would be small. Most of it would come from people who no longer have to work, or can downshift to less demanding employment, because insurance will be available outside the job.
"The legislation, on net, will reduce the amount of labor used in the economy by a small amount -- roughly half a percent -- primarily by reducing the amount of labor that workers choose to supply," budget office number crunchers said in a report from last year.
Thats not how it got translated in the new report from Speaker John Boehner, R-Ohio, and other top Republicans.
No, of course not. Congressional Republicans arent interested in a credible, serious debate -- theyre interested in scoring points. In this case, a lie is more effective than the truth, so thats what theyre repeating over and over again.
The key here is understanding that the health care law may reduce the labor supply, not the number of jobs. The possible 0.5% shift in labor is not the result of employers cutting jobs, its the result of people working less. And why might people work less? Because some workers might decide to retire earlier, knowing that they wont have to keep working in order to have health care benefits. (And when these older workers leave the workforce, it creates opportunities for younger workers.)
The 650,000 figure is a sham, pushed by professional con artists who assume the public and the media wont arent pay close attention anyway. Some will believe the lie, and there wont be any consequences of the dishonesty anyway.
reform not refrom, sorry.
Answer: I don't trust Republicans at all on this issue.
First, THEY propose the "individual mandate" (back in the 90's, in response to "Hillarycare"), but NOW it's "unconstitutional"?
In fact, most of the health reform are based on the Republican model from the 90's, but you'll never hear them admit to it, just as you'll never hear them admit that there are over 160 TAX CUTS for small businesses in the bill!
Not only that, but with all the "repeal and replace" they've been screaming since it's passage, I have yet to hear them propose ANYTHING they would "replace" it with.
Republicans have proved, over and over, that they are not to be trusted.

Hardship license after a 1st DUI in Mississippi?
I got my first DUI in Mississippi and the DUI statute says I can obtain a hardship license after 30 days of a suspended drivers license. In order to save money I filed a petition for hardship myself instead of hiring a lawyer to do it. I had a copy of an approved hardship petition from another case and used it as a guide to make sure I didnt miss anything. I called the court about a week after I filed it and the court clerk said the judge doesnt grant hardship licenses and it was denied. I informed the clerk about several other cases that the judge has granted hardship licenses and I even got a signed letter from the Mississippi Dept. of Public Safety saying that they have no objection to granting me a hardship. She said the judges ruling is final and basically theres nothing I can do about it. Is this true even if the Mississippi DPS says its ok and the state statute says Im entitled to a hardship? This is how the statute reads verbatim,
The circuit court having jurisdiction in the county in which the conviction was had or the circuit court of the persons county of residence may reduce the suspension of driving privileges under Section 63-11-30(2) (a) if the denial of which would constitute a hardship on the offender, except that no court may issue such an order reducing the suspension of driving privileges under this subsection until thirty (30) days have elapsed from the effective date of the suspension. Hardships shall only apply to first offenses under Section 63-11-30(1), and shall not apply to second, third or subsequent convictions of any person violating subsection (1) of this section. A reduction of suspension on the basis of hardship shall not be available to any person who refused to submit to a chemical test upon the request of a law enforcement officer as provided in Section 63-11-5. When the petition is filed, such person shall pay to the circuit clerk of the court where the petition is filed a fee of Fifty Dollars ($50.00), which shall be deposited into the State General Fund to the credit of a special fund hereby created in the State Treasury to be used for alcohol or drug abuse treatment and education, upon appropriation by the Legislature. This fee shall be in addition to any other court costs or fees required for the filing of petitions." This is the link for the full statute

Its my first offense, I didnt refuse a chemical test, and I need a hardship to continue my employment and attend college classes.
Any help is appreciated as to why it was denied.
Answer: The first sentence of the law you quoted above has your answer. "The circuit court having jurisdiction in the county in which the conviction was had or the circuit court of the person's county of residence MAY reduce the suspension of driving privileges under Section 63-11-30..."
You should notice the word, may. If the judge had to do it would say, shall. It is up to the judge. It is simple as that.
