If theres no lease....?
Two years ago my fiance, who Ill call "Sam" put down his name on an application and lease for a house, along with his mothers name, who Ill call "Dawn", because his credit was almost perfect while hers was very poor. Hes the only reason she got this house, and we moved in as well. The first year seemed to go okay, and along with us giving her between 600-1100 dollars a month for rent, groceries utilities ad cable/phone/net, we also had his aunt and uncle living with us who also gave the same amount every month. The rent was 1500 and Dawn and her husband worked, so there was money coming in from them too. Last January, in 2008, the year lease was up. It was not renewed, and nothin was said about it from either the landlord or any of us. This past December, we found out that despite Dawn saying she would pay everything as long as she got money, the rent was not being paid. It hasnt been paid in eight months, even though there was enough money coming into the household for everything, at least enough to keep the wolves at bay, if you know what I mean. So Sam stopped giving his mom money, and took over the electric bill despite her protests because its in his name anyway. Were caught up on that at least. But Im infuriated over the fact that Dawn has lied to us, taken our money, not paid rent and pretty much taken advantage of us and used us, and has muddied up Sams good name, and his good credit. We decided to move out, move back to my home state, not just to be closer to my family but to get away from this situation. While waiting to hear if we were going to get a place, his mom goes and finds a new house and manages to get it, and used her tax return as first months rent and security deposit and rushed to move out of here. Sam and I will be out of here by March first, even though we were hoping to go before they did. But now the landlord has called our cell, because the other numbers she had for Dawn arent in service, since they moved they got a new number. So I made a decision. I let the landlord know what has happened this past year. I told her Dawn lied to us and took our money saying she was paying rent but that she obviously wasnt. The landlord informed me that Dawn claimed she was a "victim of identity theft" and that she would get things straightened out with her tax return and start paying the back rent and catch up. So I told the landlord that Dawn actually used it to move somewhere else, that she left us behind (we certainly were not going to move twice, besides Id rather not have my baby girl there with Dawn and her creepy common sense lacking husband anyway which is a whole nother story) and that wed be moving ourselves. I gave her Dawns new number and work number, and today the landlord calls again and tells me that Dawns sister told her that "no Dawn didnt move". Well, I dont know whats going on there, but Im sure Dawn is trying to get out of this problem and is trying to run away from it. I also informed her that Dawns identity was never stolen, that she was getting money for rent and we only just found out ourselves that that money disappeared and that we have no idea where it went.
I let her know wed be out of the house ourselves by the end of the month and thankfully the woman was understanding to our part of the story. She feels like a chump for being understanding and nice to Dawn when she was actually being lied to, just the same as us.
What I want to know is, is that since there was no lease for this past year, what will happen with this situation? I gues technically we could be squatters, which I hate the idea of that, but it was unknowingly thrust upon us really. If the landlord has a right to take legal action to get the back rent, will Shawn be held responsible? even though there was no lease for this past year, and he trusted his own MOTHER to to pay the rent like she said she would but just took his money and lied to him instead? What can we do ourselves? If it comes to needing a lawyer, we dont have the money for legal fees. Maybe we would if we had all the rent money we gave his mom back.
Any help with this that anyone can provide is greatly appreciated very much, and thanks for sticking with reading this through to the end lol
Oh and no we have not talked to his mother about this. How does one go about saying to his mom "i know you lied to me and took my money and spent on god knows what instead of the rent"? Its just so wrong when youre supposed to be able to trust your mom and when it turns out you cant who are you supposed to trust?
Answer: I am surprised you got away with living there 8 mos rent free. That is just odd.
At any rate, since Sam and Dawn are on the lease they are both jointly and separately responsible for the rent. And, it doesn't matter that your lease ran out. After your lease ends, and you remain, you are on a month to month tenancy. Just because the landlady didn't bring up signing a new lease doesn't mean you get to live there gratis. (Even though, in essence you were! LOL)
Any back rent needs to be paid regardless. If the landlord isn't as much of a pushover as she sounds, she should take Sam and Dawn to small claims court if they do not pay her. If you can prove the mother stole money, you can sue her. I highly doubt that will happen though.
But, yes, you owe the landlord. So does mom.

How can I find my deceased mothers obituary or her family?
Ok, quick background to help you understand where Im coming from:
When I was 7 my biological father sent me to live with my aunt and uncle. My mother had "taken off" a few months prior and he decided it would be best for them to raise me so I wouldnt grow up in a house where my parents were constantly fighting and leaving. A few months after I moved in with my aunt and uncle my dad visited me to tell me that my mother had died. I suppose telling your 7 year old daughter that their mom has died is a hard thing to do so it ended up being months after shed actually died before he even told me. I never got to say good-bye and Ive never gotten over her dying, even though she wasnt really there for me while she was alive. Not being able to say good-bye has caused me to not even be able to accept the fact that shes dead. I have these little fantasies in my head that one day Ill be at the grocery store and Ill run into her miraculously and Ill find out this whole thing was a cover-up or something. Stupid, I know, but I still have hopes.
Ive since fallen out of touch with my biological father and my aunt and uncle have lost the address of the one relative of my mothers I was always close to. Heres what I do know:
My mothers name (as printed on my birth certificate) was: Virginia Claudette Allen Holloway (Allen is her maiden name). Everyone called her "Ginger". She was born on December 2, 1963 somewhere in North Carolina and died sometime in 1998. I was told she was living in either Tennessee or North Carolina when she died but Im 98% sure her ashes were spread in Murfreesboro, Tennessee. At the time I was born (1991) she lived in Durham, NC (if that matters).
Her sister (the relative I was close to) was named Tammy. I cant remember her last name but I know she was married and her husband had a heart attack and died. I think they lived in or around Durham, NC, but Im not entirely sure. She also had a little girl named Mary and a son, whose name I cannot remember but for some reason Matthew rings a bell. My mom also had a sister named Terri, who also died. She had another sister also who I always called "Aunt Sam".
I dont know if any of this information is useful but Im longing to find my mothers family and her obituary for some closure. I dont know what county she died in or what state for sure and I have no clue what funeral home was used. If anyone could please give me some guidance as to how to continue in my search please, please help. Ive been searching for the past 2 years and Im exhausted and very frustrated. Thanks so much in advance! :)
Answer: You could try to locate your father then see what he knows.
You may not find an obituary, but you should be able to get a copy of her death certificate. Here are some sites that might help:

1 - Based on the US Social Security Death Index, this site has a number of search options. I have located records on several deceased family members here. You have enough information to do a good search. I searched for your mother’s name and didn’t find it. (Now, I have hopes too.)

I need serious financial help... where can I go?
I am in deep poo. I feel like I have exhausted every option Ive had to try and save myself from the debt Im in, and I just cant get away from it. Heres why:
Im a single, 22-year old college kid that has just moved into a new state (Arizona) and Ive been struggling to live on my own for about a year. I am not getting support from family, and will not.
Last week, I made the decision to drop out of my classes to get a second job because Im in real hot water as it is, but that means in six months my loans will go into payment mode.
Unfortunately, nobody is going to hire a 22-year-old skill-less girl who can only speak one language around here.
I make about 1200 a month (I apparently make a lot more, but Uncle Sam makes sure he takes out about 400 a month for taxes and Social Security, something I dont even think Ill get to enjoy) or a bit less. By the time my "essential" bills are paid -- cell phone, rent, car note, car insurance, and the gas I require to get to work at my first job, I actually OWE the bank money in overages.
But it doesnt stop there -- that estimate doesnt even include groceries, renters insurance (which Ive been avoiding getting because of this), internet (essential for various reasons), vet care, car maintenance, or the 5 thousand dollars of credit card debt I have. :( Yes, I was a stupid college kid, and my dad told me to live off of them because he couldnt support me and it took me that long to find a job. And the student loans are coming.... I need to be making TWICE what Im making now just to break even.
Ive tried refinancing my car. No one will touch me - again, 22 year old with no past history in the state. My bank will not offer help, and the credit card companies (even though Ive called them and theyve lied to me on multiple occasions) are refusing to lower my APR from 29.99% and wont work with me to get the cards closed or put me on a payment plan. I cant even afford the minimum payments with an APR like that, how can I ever even hope to get it paid off??? I dont qualify for food stamps (I make too much money) or any federal aid that I know of. Going bankrupt will ruin me for the first seven years of my life, Ill be 30 before I can twitch financially again.
If it were an option, I would break my lease and move further out where the rent is half as costly. Im in my lease for another 10 months, but the owners announced the property was listed in bankruptcy only one month after I signed it and I have no idea what that means for me.
Anyway, I am really looking for serious advice... maybe theres some programs I havent found out about, or something. This is just stupid.

When do we get it through our heads we have no right to a job, no right to health care, no right to a house, and no right to food? When do we wake up and take responsibility for our own lives and face the fact our government only takes for themselves and redistributes to those who lick their boots and grovel to their causes?
When do we become Americans again and quit expecting more than we work for?
Those of us who want socialism/communism are those on welfare and this we have concluded is the reason for the government not requiring work for welfare or even publicizing those who get it for nothing. We who get it without working 40 hours a week for it leaves us without dignity and susceptible to dependence on a social ruling class who picks and chooses who gets what. We do not for one moment believe they will pay themselves the same as the lowest paid party member.
Does anyone out here believe such a thing? It is said "a fool is born every minuet" but we believe that has increased exponentially in direct relation to the academic drop out rate in the American educational system. Talk about a systemic breakdown! You think? Or is anyone thinking clearly anymore? We dont think so.
How long would anyone who is budgeting keep a meaningful credit rating if we would spend our incomes at the same rate as our government is spending our incomes? So is it logical that our government isnt destined to last any longer? Common sense is a rarity in this day in age as well we are experiencing to our inevitable ruination of our nation. But then it is not our problem. It is our kids problem now and we are having to spend their inheritance to retain our standard of living we have earned the right to enjoy.
Justification is in adopting the same kiddish attitude that it is our right and if we overspend, so what? The government will take care of our housing, health, and feeding because it is their responsibility and no longer that of the individual. Isnt this now the logic and common sense solution of our nation now?
But it grinds on our nerves that some people are getting a government income without having to do a lick of work. This will change when the communist socialists take over and we are happy for this because it will affect those dropouts in the most miserable fashion unimaginable. Rude awakenings are most shocking and ours is coming just in time to make us glad for the enlightenment.
Is it logical to think that equal pay is fair? If we sit behind a desk and push paper 40 hours a week and you all dig the ditches and sling our trash all day for the same wage as we in the a/c office, how fair is that to you? Common sense tells us it isnt but if this is what you all choose then good little socialite you all shall be. How many unions are in China, North Korea, Cuba, and how many did the USSR have? And how evenly distributed is their wealth among the peons? If this is what we want then so be it. "The grass always looks greener on the other side". Have fun all of you. We "...all have to sleep in the beds we make". "Promises are made to be broken" and dont look now but "the proof is in the pudding".
While we are waiting for utopia we are having a ball spending your inheritances. Thank you for letting us off the hook by dropping out of school and playing the system. We no longer have to feel obligated because all of you have finally convinced us that Uncle Sam is going to provide you with all you need as long as you provide him with all you have for your labor. Youll get your equal share as promised. Just like Gitmo was promised to be closed long ago. "A fool is born every minute".
So, as we see it, not only is the government seeking to become our god for us to worship, government is actively striving to become Big business. Does anyone fool themselves into believing that any form of government will allow themselves to be bargained with? We have just seen what government does when they bust their budgets in WI, IL, and Ohio.
Unions have no place in government because it is the same as if we were able to bargain for wages and benefits with our employer who depends upon our vote for keeping their job. Of course they will give in to anything which allows them to retain their power over the business they conduct. General Motors and Chrysler are good examples of "giving away the store" to keep the product rolling smoothly into production. We bailed them out with our money and what have we gotten for it? Closed auto plants, Chrysler sold to a foreign country, and laid off workers not to mention the sky rocketing cost of owning a new or used car.
When we speak
of bargaining with government as a business then we are just trading off one Big business for another Bigger business and can only expect to be treated like GM treated their employees.
When government becomes like big business we see how they treat their "employees" by looking at whats going on in countries around the world at this moment. Who is going to come to our defense when we are in the streets?
Only fools or the most selfish hearted people want their government to become Big Business because we are only trading one greedy group for another Biggest greedy of all group with no protection from their "Big Guns". Wisconsin reacted the same way as our company did when they got their financial teat in a wringer. They froze our pay and benefits until they found a business to take over our department and forced us out of our pension and $25 an hour wage. We found us working at our same company for the agency they hired for 1/2 the wage and trying to pay our own pension plan while l
while looking for a better place to work.
Trouble is, if government is the best job and cuts back like Wisconsin did, then where do we look for a better income when government is the only business left to work at?
No fooling here.
As far as Iran, this is where Saddam moved his weapons of mass destruction before we could arrive and the reason we didnt find any WMDs.
