Should wages & benefits of re-employed workers be cut?

The Straits Times. 9 Jul 2011 Pay, benefit issues for re-employed workers Firms weighing which way to go before new law takes effect in Jan By Cai Haoxiang SIX months ahead of a law requiring employers to rehire staff who reach the retirement age of 62, the good news is, many are keen to keep these workers on. But unionists have identified two areas of concern: reduced pay and medical benefits. Informal polls by the National Trades Union Congress (NTUC), the Singapore National Employers Federation and The Straits Times have uncovered a wide range of employer practices in these areas. Some employers offer staff who reach the statutory retirement age an opportunity to keep working on the same terms, but others cut wages and benefits. Some 20 statutory board workers who were re-employed this month saw their basic wages cut by an average of 23 per cent, the Amalgamated Union of Statutory Board Employees said. Most of the workers were either in the rank and file or in junior management roles, earning between $2,000 and $3,000 a month. Unionists are also worried about reduced medical benefits. Some companies take re-employed workers off their group medical insurance schemes, and give them instead a sum of money to buy private insurance. The problem is that many older workers have pre-existing illnesses, and it could be costly and difficult for them to find another insurer to take them on, NTUC assistant secretary-general Cham Hui Fong said. The Retirement and Re-employment Act passed by Parliament in January this year requires employers to give workers the option of working beyond the statutory retirement age of 62 - first until 65 and later until 67. The legislation takes effect next January. Under the new law, when they turn 62, workers will be offered new contracts and re-employed. The tripartite guidelines on re-employment allow for salary adjustments, because the wages of some older workers might be much higher than those of younger workers doing the same job, given the seniority-based wage system observed for many years. However, Ms Cham urged employers to look at other reasonable factors as well, such as performance, before cutting wages. Ms Cham, who is also NTUCs industrial relations director, said unions were in talks with companies regarding the wage issue. Just two weeks ago, two major employers struck deals with their unions not to cut the pay for re-employed workers if they performed above a certain level. The two companies cannot be named as their workers have not been informed. A related concern is the reluctance of some employers to grant annual increments to re-employed workers. Calling on employers to treat these workers fairly, Ms Cham said they should be entitled to bonuses and salary increments. The Ministry of Manpower said that in the coming months, its re-employment campaign would focus on educating employers and employees about their respective obligations and rights. It said it also hopes to deepen employers awareness of the resources available to help them implement re-employment. Meanwhile, in sectors such as health care and security, because of a labour shortage, some employers actually offer older workers better terms. Mr Desmond Choo, the executive secretary of the Union of Security Employees, said security guards aged above 60 were paid allowances and annual increments. Companies even actively employ people above 60, he said.
